General Terms and Conditions of Sale Abrakadabra

General Principles

The sales and services of Abrakadabra are subject to these general terms and conditions, which prevail over any purchase conditions, unless formally and expressly agreed otherwise by Abrakadabra.

Products

The products available for sale are those listed in our sales documents. Abrakadabra reserves the right to modify the range of products at any time. Furthermore, the characteristics or photos in our sales documents are for indicative purposes only.

Delivery Times

Upon receipt of your order, you will receive an acknowledgment of receipt along with the estimated shipping times whenever possible. It is expressly understood that these timeframes are only indicative. A delivery delay cannot give rise to penalties, damages, or justify the cancellation of the order.

Transport

Products always travel at the recipient’s risk. It is important to always check the packages upon receipt, make all detailed reservations with the carrier on the waybill, and confirm these reservations to the carrier by registered letter with acknowledgment of receipt within three days of delivery, in accordance with Article L 133-3 of the French Commercial Code, in cases of damage, loss, breakage, theft, etc. Shipments are made at the discretion of the sender by any means of transport offering the best quality-price ratio. A transport fee may be requested depending on the shipping location. This fee will be mentioned in the acknowledgment of receipt sent to the customer.

Returns

If the delivered products do not meet the customer’s expectations, Abrakadabra may accept the return under the following conditions:

• The returned product must be in perfect condition, with all its accessories and documentation, and in its original, unaltered packaging.
• Return shipping costs are the responsibility of the customer.
• The return must be made within a maximum of 15 days from the date of product delivery (excluding school holidays for our educational institution customers).

Prices

All our prices include VAT. The catalog prices are set as of January 1, 2019. Throughout the year, these prices may be subject to increases by publishers and possible changes in exchange rates.

Payment Terms

• Payment terms (Professionals): Payment upon receipt of invoice.
• Payment terms (Individuals): Advance payment required.
• Discount: No discount will be granted for early payment.
• Late payment penalties: Any amount not paid by its due date will automatically incur late payment interest according to applicable law.

Warranty

All product sales are subject to legal warranties, including the warranty against hidden defects as defined in Articles 1641 and following of the French Civil Code.

Retention of Title Clause

Abrakadabra retains ownership of the goods sold until full payment has been received. Until that date, the delivered products will be considered consigned, and the customer will bear all risks related to any damage the products may sustain or cause, for any reason.

Data Protection

Any order registration or quotation request results in the creation of an automated file, in accordance with the provisions of the French Data Protection Law of January 6, 1978, on behalf of Abrakadabra. You have the right to access, modify, rectify, and delete your personal data.

Jurisdiction

Unless otherwise required by law, the court of Grenoble shall have exclusive jurisdiction.
